McGREGOR, J.

Defendant was convicted, largely by circumstantial evidence, in a nonjury trial of the offense of second-degree murder, MCLA 750.317; MSA 28.549, and was sentenced to life imprisonment.

The trial court made the following finding of facts, all of which were fully substantiated by the evidence:

"At between 10 and 10:30 a.m. in the Township of Highland, Oakland County on the 18th of July, 1970...
