The plaintiff, a citizen of North Carolina, has brought this action against the defendant, a citizen of Virginia, to recover money which the plaintiff claims was wrongfully and illegally taken from the Leonard Tire Company by the defendant while he was president of this company. The tire company is presently in bankruptcy proceedings in the United States District Court for the Eastern District of North Carolina....
