MARTINEZ, Justice.

The defendant was found guilty of four counts of murder on September 27, 1968 and on September 30, 1968 was sentenced to death by lethal gas. Pursuant to §§ 40A-29-2.1 through 2.3 N.M.S.A. 1953 Comp. (2d Repl. Vol. 6, 1972) the New Mexico Supreme Court issued a Mandate to the District Court of Grant County on September 30, 1969 for resentencing.
