The issue in this case is the propriety of exclusion from the Aid to Families with Dependent Children (AFDC) program of wives with husbands in pretrial confinement. Section 49.19(4) (d) (2) of the Wisconsin statutes, despite some rather confusing wording, allows granting of aid to wives whose husbands have been sentenced to penal institutions.
