OPINION AND ORDER

CHILSON, District Judge.

Plaintiff brings this action under 42 U.S.C. § 1983. The complaint asserts jurisdiction pursuant to 28 U.S.C. § 1343.

Plaintiff alleges that defendant, Earl Valdez, acting under color of law as a police officer (deputy sheriff), illegally arrested plaintiff and that Valdez struck plaintiff causing physical injury.
