These eight separate actions, consolidated for the purpose of considering cross-motions for summary judgment, involve leisure home development projects ("lagoon projects")1 located generally in the southeastern section of Sussex County, Delaware near either Indian River Bay, Rehoboth Bay, Little Assawoman Bay or Assawoman Bay.
