Plaintiff-appellant, State of Indiana (State), brought its action against Ollie Quackenbush, et al. (Quackenbush) to appropriate certain real estate. The land condemned was four acres owned by Quackenbush for improvement to State Road 37 (Bedford By-Pass.)
