This action results from a collision between an automobile driven by Warren Von Lindern, who was killed in the accident, and a Union Pacific train in which defendant C.L. Hegstrom was the engineer. Following trial, a jury returned a verdict in favor of plaintiffs in the amount of $51,495. Defendants appeal from the verdict and the judgment entered thereon, and plaintiffs cross-appeal.
