The issue in this case1 is whether defendant was deprived of his right to a speedy trial2 under the new rule set forth in Barker v Wingo, 407 U.S. 514; 92 S.Ct. 2182; 33 L Ed 2d 101 (1972) which reads:

"A balancing test necessarily compels courts to approach speedy trial on an ad hoc basis. * * * Though some might express them in different ways...
