WATSON v. GODWIN

No. P-370.

259 So.2d 746 (1972)

W.H. WATSON and Abbie Watson, Husband and Wife, Appellants, v. Wayne GODWIN, Appellee.

District Court of Appeal of Florida, First District.

Rehearing Denied April 14, 1972.

Attorney(s) appearing for the Case

A.G. Condon, Jr. of Holsberry, Emmanuel, Sheppard, Mitchell & Condon, Pensacola, for appellants.

James A. Johnston, of Fitzgerald & Johnston, Pensacola, for appellee.

JOHNSON, Judge.

This is an appeal from a final judgment in an ejectment suit instituted by appellants. The case was tried before a jury and resulted in a verdict for the appellants. Notwithstanding the verdict, the court set it aside and entered final judgment for the appellee. Hence, this appeal ensues.

The sole issue for our determination is whether the trial court erred in setting aside the jury verdict and entering judgment for the appellee.
