This matter was before the Court for a hearing on a Petition for a Preliminary Injunction on October 22, 1971. Prior to the hearing, defendant moved for a judgment on the pleadings, which motion we treated as a motion to dismiss under Rule 12 of the Federal Rules of Civil Procedure.
