WIDENER, District Judge.

Petitioner is confined by the Commonwealth of Virginia on account of conviction of rape. He has filed, in forma pauperis, a petition for writ of habeas corpus pursuant to the provisions of 28 U.S.C. § 2241.

On June 21, 1958, the petitioner was arrested upon a warrant issued that same date charging him with the rape of a ten year old child. On July 7, 1958, an indictment was returned on the charge and the court...
