STEEL, District Judge:

This is an action for patent infringement of U. S. Letters Patent No. 3,271,916 issued on September 13, 1966 to Ray E. Omholt for Uniformly Resilient Flooring Systems. Plaintiff is the assignee of the patent and charges that since its issuance defendant, who competes with plaintiff in the manufacture and sale of flooring, has infringed the patent by making and selling flooring systems embodying the patented invention.
