LACEY, District Judge:

Plaintiff sues under Section 301 of the Labor Management Relations Act (29 U.S.C. § 185), charging his former employer with wrongful discharge and his union with breach of its duty of fair representation.

Trial was had herein on September 28 and 30, 1971.
