The plaintiff is a Colville Indian of full blood, who owns a store on allotted land which is held in trust by the United States Government. His business is mainly that of selling cigarettes, and he sells approximately 400 cartons each day. His customers are Indians and nonIndians, but the majority are nonIndians.

The plaintiff has operated without the license required by RCW 19.91.120 and has not registered...
