MEMORANDUM OPINION AND ORDER

WOODWARD, District Judge.

The plaintiff, H. L. Moore, was an eighth grade history teacher in the Borger Independent School District and had been employed as a teacher in that district for eighteen years until he was suspended from his teaching duties on January 7, 1970.
