BUSSEY, Presiding Judge:

Buford Dale Croney and Bill Wayne Croney, hereinafter referred to as defendants were charged, tried and convicted in the District Court of Logan County of the offense of Burglary in the Second Degree, their punishment was fixed at three and one-half (3 1/2) years imprisonment, and from said judgment and sentence a timely appeal has been perfected to this Court.
