OPINION

NYE, Chief Justice.

This is a suit by appellee to mature an award by the Industrial Accident Board. The trial was to the court without a jury resulting in a judgment for the full amount of the award, plus penalty and attorney fees. The Workmen's Compensation statute provides that when the Industrial Accident Board makes a final award against the insurance carrier, and the carrier shall fail or refuse "without justifiable cause" to make the payments...
