MEMORANDUM AND ORDER

This matter comes before the Court upon defendant's motion for new trial. [Filing # 64].

Defendant was charged with violating Int.Rev.Code of 1954, § 7201 which provides:

"Attempt to Evade or Defeat Tax. Any person who willfully attempts in any manner to evade or defeat any tax imposed by this title or the payment thereof...
