Calvin Gunn was indicted, tried and convicted of the offense of foeticide. The indictment was returned at the November, 1969 term of court and alleged that the crime was committed on November 22, 1969. A motion for new trial was filed and overruled and a motion in arrest of judgment filed. The latter motion was overruled on March 4, 1971, and the present appeal filed.
