MERHIGE, District Judge.
Francis X. Ferguson, Jr. and James M. Ferguson, infants under the age of twenty-one (21) years, instituted suit by Mary Donleavy Ferguson, their mother and next friend, in the amount of ten thousand ($10,000.00) dollars, seeking proceeds under a National Service Life Insurance Policy.
