MEMORANDUM OPINION

TURRENTINE, District Judge.

On September 12, 1968, the defendant, Gustavo Osuna-Picos, age 20, a native and citizen of Mexico, entered the United States from Tijuana, Mexico, through the port of entry at San Ysidro, California. The defendant presented no documents to the immigration inspector but gained entry into the United States by pretending to be a United States citizen.
