JONES, Justice.

Troy Duncan was tried before the Washington County Circuit Court, sitting as a jury, and was convicted of possession and delivering of certain depressant or stimulant drugs. He was sentenced to two years in the penitentiary with one year suspended and was fined $1,500 on each count. On appeal to this court Duncan relies on the following point for reversal:

"The Court erred in holding the appellant guilty in that the evidence showed a case...
