REEDER v. STATE

No. 5496.

455 S.W.2d 92 (1970)

Billy REEDER, Appellant, v. STATE of Arkansas, Appellee.

Supreme Court of Arkansas.

June 1, 1970.

Attorney(s) appearing for the Case

Garner & Parker, Ft. Smith, for appellant.

Joe Purcell, Atty. Gen., Mike Wilson, Asst. Atty. Gen., Little Rock, for appellee.

BYRD, Justice.

The sole issue on this appeal by Billy Reeder is whether the trial court could suspend for three years a one year sentence assessed by the jury.

The record shows that the jury found Reeder guilty of operating a gambling house contrary to Ark.Stat.Ann. § 41-2001 (Repl. 1964) and fixed his punishment at one year with a recommendation that it be suspended. The trial court suspended the one year sentence for a period of three years.
