Von Reeden, hereafter referred to as defendant was tried on October 24, 1967, on a charge of murder and on November 1, 1967, found guilty by the jury of murder second degree, and sentenced to a term of not less than 10 years nor more than 15 years in the Arizona State Penitentiary.
