FITZGERALD, J.

Defendant Jessie Goldsmith was charged with having had carnal knowledge of a female over the age of 16 years by force and against her will, contrary to MCLA § 750.520 (Stat Ann 1954 Rev § 28.788). Defendant was tried by a jury and found guilty of the crime for which he was charged. On March 5, 1968, defendant was sentenced to serve 20 to 40 years in prison.
