On June 18, 1970 James Charles Mazenis submitted to induction in the armed forces pursuant to an order of his draft board. He immediately filed a petition for a writ of habeas corpus, challenging the validity of the order. The district court denied the petition without an evidentiary hearing, and petitioner appealed.
