This is an appeal upon questions of law from orders of the Court of Common Pleas of Hamilton County overruling a motion for a new trial and granting judgment on a verdict.

Appellant, the defendant Singer Company, has set forth two assignments of error. The first is that the trial court erred in failing to sustain its motions for summary judgment, for a directed verdict at the end of the plaintiff's
