This action originally sought judicial review of the decision of the Secretary of Health, Education and Welfare (HEW) denying plaintiff disability benefits under the Social Security Act, 42 U.S.C. §§ 416 and 423. On motion of the Secretary before answer, the case was remanded and plaintiff's claim granted by the Secretary.
