BODY, District Judge.

The relator is presently confined at the State Correctional Institution at Philadelphia, Pennsylvania, on a one to ten year sentence imposed on September 20, 1968 for conviction on Bill No. 523, November Term 1965, in the County of Montgomery, charging burglary, larceny and conspiracy to commit burglary.
