This is a workmen's compensation case where there was a trial before the Labor Commissioner who ruled that claimant was entitled to compensation for the death of John E. Kane. The employer appealed and claimant filed a motion asking for a ruling that the burden of proof be upon the employer, and that the employer was not entitled to a trial de novo. The Trial Court (Dunfey, J.) reserved and transferred the questions raised by this motion...
