The defendant was convicted in the Superior Court by a judge sitting without a jury for violation of G.L.c. 98, § 56B,1 and was fined $100. His exceptions are to the denial of his motion for the entry of a finding of not guilty and to the finding of guilty. The defendant's motion and his brief raise only the constitutional issues discussed below.
