This is an appeal by plaintiff from an order quashing a garnishment proceeding against Mystic Tape Corporation on behalf of defendant for the use of plaintiff.

The original action alleged that defendant fired a pistol at and upon plaintiff. A jury demand was filed by plaintiff and defendant appeared and also filed an answer denying the allegations of plaintiff's complaint. However,
