STEINFELD, Judge.

Appellees, the chairman and four members of the Executive Committee of the Magoffin County Democratic Party (hereafter County Committee), sued the Magoffin County Board of Election Commissioners (hereafter Board), its members, the sheriff and clerk of that county. The action was for the purpose of resolving a controversy over election officers appointed to represent the Democratic Party at the polls at the general election on November 4, 1969.
