MEMORANDUM OPINION AND ORDER
DAUGHERTY, District Judge.
Petitioner proceeds herein seeking a writ of habeas corpus for the purpose of effecting his release from a state sentence of death upon a conviction of murder. Of the twelve grounds raised in his Petition originally before this Court, only two remain, which will be considered together with a new ground subsequently raised at the state level.
