This is a diversity action arising out of an intersection collision which occurred in Denver, Colorado, on January 20, 1967. The plaintiff, Myrtell Bergeson,1 was a passenger in a vehicle which was proceeding against a red light as a part of a funeral procession when it collided with a vehicle driven by the defendant, Robert Shinnen.
