This matter is now before the Court on the petition of Donald Eugene Johnson for a writ of habeas corpus.

Petitioner was indicted and tried by a jury for the crime of uttering and drawing a false check in violation of Section 713.3, Code of Iowa (1962). On October 20, 1966, the jury returned a verdict finding petitioner guilty as charged, and petitioner was subsequently sentenced to the Iowa State Penitentiary...
