MORRIS, Judge.

The offense for which defendant was tried at the October 1967 Session occurred on 28 December 1954. At the August 1955 Term of Nash County Superior Court, he entered a plea of nolo contendere and was sentenced to a term of 10 years in State's Prison. He subsequently escaped; and on 9 June 1965, he was arrested in Philadelphia, Pennsylvania, and returned to North Carolina.
