John Dalmer Benton, petitioner, was brought to trial on April 22, 1965 in the Circuit Court for Prince George's County on charges of burglary, housebreaking and larceny. The State dropped the housebreaking count, and following a jury trial on the other two counts, he was found guilty of burglary but not guilty of larceny.
