At defendant's preliminary examination his oral confession, admitted over objection, was the only evidence connecting him with the burglary. Bound over for trial, he moved to set aside the information. The superior court granted his motion, concluding that his confession was gained without an effective waiver of the rights enumerated in Miranda v.
