The evidence for the State reveals that Trooper J. H. Withers, Jr., an officer of the North Carolina State Highway Patrol, received notice of a vehicle accident and went to the scene on U. S. 64 approximately one mile west of the Town of Columbia. Trooper Withers arrived at approximately 5:00 a. m. Sunday, 9 July 1967. There were tracks of a vehicle in the road leading from a wrecked vehicle for approximately one-tenth of a mile back to the hard surface...
