MEMORANDUM OPINION AND ORDER
FULLAM, District Judge.
On January 7, 1967, the petitioner was sentenced to concurrent terms of imprisonment aggregating not less than five years nor more than twenty years, following his conviction, in a non-jury trial, of rape, robbery, aggravated assault and battery and attempted sodomy. He appealed, but the conviction was upheld per curiam, without opinion, Commonwealth
