Initially petitioner Moss filed in this court a petition for the issuance of a writ of habeas corpus alleging that (1) he was being held "in custodia legis", that (2) he had fully and completely exhausted all available state remedies and that (3) he was being placed in double jeopardy by certain state court appellate proceedings pending against him contrary to the dictates of the Fifth Amendment to the Constitution of the United States.
