Defendant was charged in two separate counts with the crime of assault with intent to murder (Pen. Code, § 217) his wife and a woman friend of his spouse. The public defender was appointed to represent the defendant; a plea of "not guilty" was entered; a jury trial was waived; and on July 17, 1963, defendant was found guilty on both counts.
