Plaintiff-in-error, Van Allen Beaver, hereinafter referred to as defendant, was indicted, tried and convicted of the crime of robbery and sentenced to a term of not more than ten years in the State Penitentiary.

Defendant has appealed and the matter is in this Court on the technical record and a narrative bill of exceptions.
