The petitioner, Nacho Garcia, was convicted in the Superior Court of Pima County, Arizona, for violation of A.R.S. § 36-1002.05(B), unlawful possession of marijuana with a prior conviction. An appeal was taken to the Arizona Supreme Court and the judgment affirmed. State v. Garcia, 97 Ariz. 102, 397 P.2d 214 (1964).
