This is an appeal from a judgment against garnishee defendant, arising out of an action on a controverted garnishment.

On the 15th of April, 1960, Viola Searle filled out an application with an agent of Temperance Insurance Exchange for an automobile insurance policy. This policy was designed for total abstainers of alcoholic beverages and was sold at rates 15 per cent less than policies of other companies...
