BRUCE, Judge:

Respondent determined a deficiency in income tax for the calendar year 1957 in the amount of $8,978.08. The sole issues for decision are whether petitioner J. Harvey Curtis, Jr., received capital gains or ordinary income in that year under an agreement and release entered into with certain other parties, and how much was received.
