This is an appeal on questions of law from a judgment of the Court of Common Pleas of Montgomery County entered upon a jury verdict for $102,000 for personal injuries sustained when an automobile, in which the plaintiff, Bruce Byrd, was a passenger, collided with a railroad engine of the defendant, The Baltimore and Ohio Railroad Company.
