This is an appeal from an order of the Warren Circuit Court denying jurisdiction to entertain the appellant's motion under RCr 11.42 to void a 1933 conviction of dwelling house breaking. Appellant duly served this sentence. In 1935 he was again convicted of dwelling house breaking in the Warren Circuit Court. This sentence was likewise served.
